Jury Delivers Swift Defense Verdict

5 years of litigation. 2 days of trial. 9 minutes for a jury decision. Waldon Adelman attorneys Kayla Bell and Lacy Smith secured a swift and resounding defense verdict in a Habersham County personal injury trial.

The plaintiff sought over $150,000 in medical bills, $25,000 in lost wages, and additional damages for pain and suffering. He alleged the rear-end accident with our client caused multiple herniated discs, which his treating physician testified necessitated surgical intervention. Plaintiff also alleged the accident caused several other issues that led to a two-day hospital stay and continued to affect his daily life nearly seven years later.

Despite the plaintiff’s claims in the admitted-fault accident, Waldon Adelman’s legal team successfully demonstrated that the plaintiff failed to meet his burden of proof that our client’s actions caused his alleged injuries. With a rigorous cross-examination, the strategic use of a biomechanical expert, and crucial pre-trial evidentiary victories, our attorneys effectively countered the plaintiff’s assertions. The jury deliberated for a mere nine minutes before returning a full defense verdict in favor of our client.

This decisive win concludes five years of litigation. Notably, the plaintiff had rejected a pre-trial statutory offer of settlement, which now leaves the plaintiff responsible for the defendant’s attorney’s fees.

“We are incredibly proud of Kayla and Lacy for their exceptional work and dedication in achieving this outstanding result,” said Partner Rakhi McNeill. “This verdict underscores our firm’s commitment to litigation excellence and our unwavering commitment to our clients.”
