Jury Clears Good Samaritan Falsely Accused in Cobb County Hit-and-Run Case

Marietta, Ga. — Associate Katherine Rouse and Partner Rakhi McNeill obtained a defense verdict in Cobb County State Court, successfully demonstrating a client falsely accused of a hit-and-run accident was actually a good Samaritan.

The case involved a mother and her 12-year-old son who alleged that the defense client struck their vehicle and fled the scene. Both plaintiffs claimed nearly identical injuries—including neck, back, and post-concussive symptoms—and sought $35,765 in medical specials. Ahead of trial, the defense extended generous Offers of Settlement, which the plaintiffs rejected. At trial, the plaintiffs asked the jury to award $105,000 in total damages.

The defense team dismantled the plaintiffs’ claims by presenting critical photographic evidence demonstrating zero contact between the two vehicles. The defense successfully showed that far from causing an accident, the client was simply a good person who pulled over to check on someone he was concerned needed assistance.

Following a two-day trial, the jury deliberated for just 1.5 hours before returning a total defense verdict, clearing the client of all liability and awarding zero damages to the plaintiffs.

“We’re glad the jury was able to see what we have known for years now,” said Rouse. “Our client is simply a good person who was trying to help a stranger when he saw they might need it.”
