Gwinnett County, GA – A Gwinnett County jury has awarded a mere $4,300 to a plaintiff who sought $122,000 in past medical expenses, claiming a traumatic brain injury and concussion after his vehicle encountered a weed eater on Buford Highway. The verdict, delivered after 2.5 hours of deliberation, represents a decisive win for Gwinnett County, led by Partner Ben Harbin.

The trial stemmed from allegations that a Gwinnett County employee failed to properly secure a weed eater in his work vehicle, leading to it falling onto the roadway. The plaintiff subsequently ran over the equipment, reporting injuries at the scene and being transported to an emergency room. Throughout the litigation, the plaintiff presented extensive medical records and the testimony of his treating neurologist, claiming diagnoses of a traumatic brain injury and concussion, and detailing treatment that included ER visits, MRIs, chiropractic care, neurology, psychotherapy, and facet injections.

However, the thorough work of the defense team proved pivotal. Harbin’s strategic presentation of evidence and cross-examination effectively challenged the plaintiff’s claims of severe and long-term neurological damage. The jury’s limited award, specifically compensating the plaintiff for only his day-of treatment, strongly indicates their skepticism regarding the alleged concussion and other neuro-related problems. This outcome underscores the defense’s success in discrediting the more substantial injury claims and protecting Gwinnett County from a significantly larger financial exposure.
